We have all seen too many occasions when one or more parties has thought that something entirely different had been agreed at the outset of a commercial relationship. When this happens it is the written contract between the parties that will become the centre of any dispute. It is for this reason that it is imperative that any policy of insurance is drafted correctly to ensure that the insurer is not providing cover for exposures outside of that was intended at the acceptance of the risk.

Many of our team have advised on some aspect of most of the London professional indemnity market’s policy wordings. This gives them an invaluable insight into how to draft a policy wording so as to avoid any confusion at a later date, long after the risk incepted.

In addition to policy drafting, we also advise insurers, insurance brokers and insured professionals in the event that there is a disagreement over the meaning of a policy wording as our depth of experience gives us a unique insight into the construction of policy language and the remedies available.

John has a wealth of expertise in providing policy advice. This includes policy drafting and advice on policy interpretation. He has advised most of the London professional indemnity market on some aspect of their policy wordings and has, in conjunction with the Underwriters, produced numerous policies and endorsements for many of the leading insurers in the professional indemnity market.

John also has enormous experience in acting for one of the parties in relation to policy interpretation differences and disputes, including many high profile cases. His experience in drafting policies gives him an invaluable insight when differences arise on the interpretation of policy provisions. He has used this insight to obtain successful outcomes for his clients on many occasions without the need to resort to dispute resolution.

Robert has more than 20 years experience advising on policy coverage; acting in policy disputes and drafting wordings. Robert has acted for diverse clients in the London insurance market during this time and is committed to reinforcing the value of their products. This is founded first of all on the conduct of countless cases on joint retainers for Insurers and Insureds in which the legal adviser is critical to maintaining a fair balance between the parties to the insurance contract working as it was intended. Robert has particular interest in some of the more unusual professional indemnity covers including D & C policies and Single Project Policies as well as reinsurance treaties and other types of liability cover including contingency insurance and marine covers including CCL. He has lectured to professional audiences on the challenges of D & C contractors’ covers and has conducted risk audits for insurers.

John is a solicitor with over thirty years' experience of insurance and other commercial litigation, in both private practice and in-house. John has extensive experience in professional negligence liability claims including those against construction professionals, solicitors, barristers, insurance brokers, managing agents, accountants and surveyors. He also has expertise in disputes relating to professional indemnity insurance policies.

John's career includes being a Practice Manager for a leading professional indemnity underwriting agency. In that role he managed claims handling and litigation under delegated authorities, drafted policy wordings and dealt with compliance issues. John qualified as a fellow of the Institute of Legal Executives in 1990, a Fellow of the Chartered Insurance Institute in 1999 and is a solicitor in the Republic of Ireland.
